THE CIRCLE SELECTS
Please read these Terms of Service ("Terms") carefully before accessing or using the website, mobile application, marketplace, or concierge services operated by The Circle Selects ("The Circle", "Platform", "we", "us", or "our"). By creating an account, browsing listings, submitting rental requests, listing items, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.
The Circle Selects is a private, members-only peer-to-peer fashion rental marketplace that connects verified Members who wish to rent and lend clothing and fashion accessories.
By using the Platform, you acknowledge and agree that:
The Circle provides technology and administrative services that facilitate transactions between Members. To the fullest extent permitted by applicable law, The Circle shall not be liable for losses, damages, disputes, claims, or expenses arising from transactions conducted between Members.
While The Circle provides tools and procedures to assist Members in documenting item condition before and after rentals, responsibility for the care, use, and return of an item remains solely with the Members participating in the transaction. The Circle does not guarantee the condition, authenticity, fit, cleanliness, merchantability, suitability, or performance of any item listed on the Platform. Any claims relating to damage, loss, theft, alteration, depreciation, or failure to return an item remain the responsibility of the Members involved in the transaction.
The Circle may coordinate delivery and return services through independent third-party logistics providers. The Circle shall not be liable for delays, failed deliveries, theft, loss, damage, service interruptions, or transportation incidents arising from services provided by third-party providers.
The Platform and all services are provided on an "as is" and "as available" basis. The Circle makes no warranties, express or implied, regarding the availability, reliability, uninterrupted operation, accuracy, or suitability of the Platform.
To the fullest extent permitted by applicable law, The Circle's total liability arising out of or relating to the Platform shall not exceed the fees paid directly to The Circle by the Member during the twelve (12) months preceding the event giving rise to the claim.
You agree to defend, indemnify, and hold harmless The Circle Selects, its affiliates, officers, directors, employees, contractors, and agents against any claims, liabilities, damages, losses, costs, expenses, or legal fees arising from or related to:
The Circle may provide administrative tools and processes designed to assist Members in documenting item condition and resolving disputes. These services may include:
The Circle's involvement in dispute resolution is administrative only. The Circle is not acting as: an insurer; a guarantor; a debt collector; a legal representative; or a court of law. The Circle may make administrative decisions relating to deposits or Platform procedures but is under no obligation to pursue legal recovery or compensation on behalf of any Member.
To help maintain a trusted community, Members may be required to provide identity verification documents, contact information, social media profiles, and any additional information reasonably requested by The Circle.
The Circle reserves the right to approve, reject, suspend, or terminate any account where it reasonably believes such action is necessary to protect the Platform, its Members, or its operations. Verification does not constitute a guarantee of a Member's future conduct, reliability, or financial responsibility.
Where disputes arise relating to damage, loss, theft, fraud, non-payment, or other material breaches of these Terms, The Circle may review available documentation and facilitate communication between Members. Any such assistance is voluntary and does not create any obligation for The Circle to act as a legal representative, insurer, debt collector, or guarantor for either party.
The Circle may disclose Member information where required by applicable law, court order, law enforcement request, regulatory inquiry, or other lawful legal process. The Circle may also cooperate with competent authorities in relation to suspected fraud, theft, criminal activity, or violations of these Terms.
The Circle reserves the right to suspend or permanently terminate any Member account for reasons including, but not limited to: Fraudulent activity. Identity misrepresentation. Non-payment of agreed obligations. Abuse of Platform policies. False claims or fabricated evidence. Harassment of Members. Repeated violations of these Terms. Termination of an account shall not affect any obligations arising prior to termination.
Upon delivery, Renters should inspect the item promptly. Any concerns regarding condition, discrepancies, or fit should be reported through the Platform within twelve (12) hours of delivery. Failure to report concerns within this period may be considered acceptance of the item's delivered condition.
Owners should inspect returned items promptly. Claims relating to stains, tears, missing embellishments, alterations, or other damage should be reported within forty-eight (48) hours of receiving the returned item. Failure to report concerns within this period may limit the ability to pursue a claim through Platform procedures.
Members submitting damage claims may be required to provide: Before and after photographs. Supporting documentation. Repair quotations or invoices. Additional information reasonably requested by The Circle. The Circle reserves the right to reject unsupported or insufficient claims.
Renters are responsible for returning items within the agreed rental period. Late returns may result in additional fees, suspension of booking privileges, or account termination.
Members who submit false claims, manipulate evidence, misuse dispute procedures, or otherwise abuse Platform protections may have their accounts suspended or permanently removed.
By using the Platform, Members consent to the collection, storage, and processing of personal information necessary for: Account administration. Identity verification. Security. Fraud prevention. Platform operations. Personal information will be handled in accordance with The Circle's Privacy Policy.
If any provision of these Terms is found to be unlawful, invalid, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
These Terms shall be governed and interpreted in accordance with the laws of the Arab Republic of Egypt. Any dispute relating directly to these Terms or the Platform shall be subject to the exclusive jurisdiction of the competent courts of Cairo, Egypt.
By creating an account, accessing the Platform, or using any services provided by The Circle Selects, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
